Landis Farm Unit Owners Association Fencing Guidelines

Declaration of Covenants & Restrictions Compliance and Guidance

Overview

To comply with the Landis Farm Unit Owners Association (“Association”) Declaration of Covenants & Restrictions (“Declaration”) and to provide consistent guidance for all Unit Owners, the following information is intended to provide guidance regarding fencing.

Restrictions

  • No Unit Owner or occupant may construct a fence anywhere within the Community without prior consent from the Architectural Review Committee (“ARC”) or the Executive Board (see Declaration Article IX Section 9.1.6).

ARC Submission Guidance

  • All fence addition plans must be approved through the ARC submission process before installation.
  • Fencing may not extend closer to the street than the rear line of the dwelling.
  • PLEASE NOTE:Dwellings with a side exterior door located forward of the rear line may request ARC approval to enclose that area with approved fencing. The fencing must not extend further toward the front line of the dwelling than is reasonably needed to enclose the side door. Any additional walkways to include a side door must also be included in an ARC submission.
  • Homeowners are responsible for fence maintenance.
  • Fencing must be installed at least two (2) feet from the side and rear property lines, except for easements, where fencing may not extend into the easement. Unit Owners must verify all stormwater and utility easements before installation.
  • For corner properties, fences may project no more than eight (8) feet toward the street from the rear, street-facing corner of the home and must be at least two (2) feet from the sidewalk edge.
  • Buried electronic wire fences for dog control are permitted, provided the location is approved through the ARC submission process before installation.
  • Unit Owners must obtain all Township approvals.

Aesthetic Guidance

  • Fence height may not exceed 54 inches.
  • Approved colors: Neutral shades, including but not limited to white, almond, clay, and black.
  • Approved materials: Composite (vinyl) and painted metal.
  • Fence style should be “open” (not solid or stockade) to maintain the community’s open feeling.

  • Article IX subsection 9.1.6, Restrictions, “Fences”:
  • “Except as set forth in Section 9.1.8 below, no Unit Owner or occupant shall be permitted to construct a fence anywhere within the Community without the prior consent of the Architectural Review Committee (or the Executive Board, if applicable).”
  • Article IX subsection 9.1.8, Restrictions, “Swimming Pools and Hot Tubs”:
  • “… The Owner of a Detached Unit may install a fence in connection with the installation of an in-ground swimming pool, provided that such fence (i) is not any higher than the minimum height required by the Municipality for fences attendant to an in-ground swimming pool; (ii) is set back at least two (2) feet from the Unit Title Lines; (iii) is not a chain-link, wire, net, stockade, solid panel or similar type fence; and (iv) may only extend from the rear corners of the Dwelling constructed on the Unit to and along the rear boundaries of Unit and no other portion of the Unit.”
  • Please note: Installations of in-ground pools must be approved by the Architectural Review Committee (or the Executive Board, if applicable)
